What is Product Liability?

When companies place products into the stream of commerce they have a legal duty to make sure that the products are reasonably safe for people who use them. Product liability refers to the liability of a manufacturer, distributor, seller, or other parties in the chain of distribution for injuries or damage caused by a defective product. When products fail because of defective design, manufacturing defects, or a failure to warn they can cause catastrophic injuries.

Types of Defective Products

Defective products often are physical products such as vehicles, machinery, household items, and children’s products however, a product can also be a social media platform. A recent verdict against Meta gained national attention when a jury found Meta and Google had been negligent in designing social media platforms that were harmful to young users. Regardless of whether a product is tangible object or an online platform, companies can be held accountable when the design of their product foreseeably causes injury.

Responsibility for Safety

The manufacturers, distributors, and sellers are responsible for the safety of their products and for warning consumers of any dangers associated with those products. Products can be defective because of defects in design, defective manufacturing, incorrect or incomplete instructions, or failure to warn of dangers and/or failure to live up to a warranty.

Strict Liability

Product liability is generally considered a strict liability tort. This means that under product liability law, a defendant can be liable when it is shown that the product is defective. It is irrelevant whether the manufacturer or supplier exercised great care in designing or manufacturing the product. If a defect in the product causes harm, the manufacturer or supplier may be found liable for it.
