Defective Toys

New York Dangerous Toys Lawsuit Attorneys

Defective toys and defective children’s products are an especially significant area of product liability law, because these products put vulnerable children, who are not capable of assessing risk, in danger. If a child in your family has been harmed because of a dangerous toy or a defective children's product, talk to a product liability lawyer at the Bonina & Bonina law firm in Brooklyn, New York.

Manufacturers, distributors and sellers are responsible for the safety of their products and for warning consumers of any dangers associated with those products. Dangerous toys and defective children’s products that result in injury to children can be the subject of a product liability lawsuit:

  • Federal recall lists: Defective toys and defective children’s products can be subject to recall. Defective toys can be voluntarily recalled by the manufacturer or subject to recalls from the United States Consumer Product Safety Commission (CPSC). Defective car seats can be recalled by the manufacturer or subject to a recall by the National Highway Transportation Safety Administration (NHTSA).

  • Dangerous toy recalls: Defective toys that were recently recalled include plush toys recommended for children between the ages 1 and 3 that posed a choking hazard and children’s rings that contained high levels of lead and posed a risk of lead poisoning to young children.

  • Defective child seat recalls: Defective car seats, defective child seats and defective booster seats recently recalled included booster seats that were improperly manufactured and were too weak in strength, violating federal safety standards. Defective child seat recalls also included more than 20 different models of Century (Graco Children’s Products) child seats with a defective adjustor that attached the seat to the car.

Product liability law is generally considered a strict liability offense. This means that under product liability law a manufacturer, distributor or seller can be liable when it is shown that a product is defective.

Dangerous toys and defective child products can cause serious injuries or even wrongful death. Products may be dangerous because of design defects, manufacturing defects, incomplete or incorrect instructions, failure to provide danger warnings, or failure to honor warranties.
