A birth injury is a brain or physical injury to an infant that occurs during the delivery process.
Common birth injuries include Cerebral Palsy, Erbs Palsy, prenatal stroke and brain damage. Too
often preventable birth injuries are caused by medical malpractice.
Cerebral Palsy is caused by an injury to the brain and in many cases is the result of medical
mistakes during the delivery process. Cerebral Palsy encompasses a variety of neurological disorders
that involve the area of the brain that controls muscle coordination and movement. A common cause
of Cerebral Palsy is decreased oxygen to the brain as a result of fetal distress, umbilical cord
entrapment or meconium aspiration. The initial signs and symptoms of Cerebral Palsy in an infant
include unresponsiveness, difficulty breathing, seizures shortly after birth, a bluish skin tone,
paralysis or poor muscle control. Difficulty sucking or feeding can also be an indication that a birth
Erbs Palsy is a condition involving damaged nerves adjacent to the shoulders which control
movement to the arms and hands. When these nerves are damaged, weakness and permanent
paralysis can occur. Nerve damage is usually caused by excessive pressure being placed on the
nerves in the infant’s shoulder during the delivery process, but can also be caused by a vacuum
assisted extraction procedures or the improper use of forceps. If the infant is too large to pass safely
through the birth canal and a physician pulls on the infant’s head during the delivery process this will
often stretch the neck and shoulders causing permanent nerve damage and Erbs Palsy.
Birth injuries are commonly caused by medical malpractice. Examples of mistakes by medical personnel that can cause a birth injury including delaying or failing to recognize the need for a Caesarean Section, failing to detect an umbilical cord wrapped around the baby’s neck, or
failing to attach enough significance to signs and symptoms of fetal distress. Additional examples
include failing to refer a woman with a high risk pregnancy to a specialist, failing to take appropriate
steps to avoid premature delivery, such as performing a cerclage, or failure to act appropriately upon
signs of oxygen deprivation to the fetus.
