Tyrone Sergio’s 1,160,000.00 Verdict in the matter of DeLos Santos v. The State of New York was upheld in its entirety by the Appellate Division, First Department. This slip and fall case involved allegations that the State had been negligent in their maintenance of a staircase.

Honorable John A. Monteleone, Justice of the Supreme Court, State of New York (retired) became of counsel to the firm. Judge Monteleone was a pioneer among judges presiding over medical malpractice cases and trials in New York.

John Bonina
John Bonina

In a case of John Bonina’s, the Appellate Division, First Department granted plaintiff’s Cross Motion and ruled that the continuous course of treatment doctrine applied to extend the Statute of Limitations in Marun v. Coleburn, 739 N.Y.S.2d 22, despite a nearly 2 year hiatus in visits to the defendant doctor. We consider this an important victory for all plaintiffs in failure to diagnose cases, as it clarifies a Statute of Limitations issue and extends the time in which many plaintiffs can sue.

John Bonina was appointed to the Executive Committee of the New York State Trial Lawyers Association.
